GENERAL TERMS AND CONDITIONS FOR OPEN LECTURES, SEMINARS AND EVENTS WITH ILJA GRZESKOWITZ

Preliminary remarks

The general terms and conditions listed here are an integral part of all contracts between the customers of Ilja Grzeskowitz (hereinafter referred to as „customer“) and Ilja Grzeskowitz and apply to open events, lectures and seminars. Any other terms and conditions of the customer shall not apply. Verbal commitments and ancillary agreements require written confirmation by Ilja Grzeskowitz. For in-house events of any kind (e.g. lectures, training courses, seminars, coaching sessions), separate General Terms and Conditions shall apply.

§1 Registration and payment
The booking of a lecture, seminar or coaching is possible by registration form or e-mail. The customer will receive a confirmation of registration by e-mail within a maximum of one week (time of contract conclusion). An invoice will be sent by separate e-mail.
If the event has a limited number of participants, registrations will be considered in the order in which payment is received.
The amount of the fee is based on the respective valid prices in the registration form and is to be transferred to the account specified in the invoice. The place in the seminar is reserved upon receipt of the money in the account. Participation in an event organized by Ilja Grzeskowitz requires full payment of the fee up to 4 weeks before the start of the seminar, workshop or coaching, unless Ilja Grzeskowitz has made a written agreement to the contrary with the customer. In the case of registration less than 4 weeks before the start of the event, payment must be made within 7 days of the invoice date, but in any case before the start of the event. Ilja Grzeskowitz reserves the right to refuse registrations without giving reasons.

§2 Cancellation policy
Right of withdrawal
The customer may withdraw from the contract in writing (e.g. letter, email) within 14 days without giving reasons. The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfillment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB and our obligations pursuant to § 312e para. 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Timely dispatch of the revocation is sufficient to comply with the revocation period.

Consequences of revocation
In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. If the customer is unable to return the service received in whole or in part or only in a deteriorated condition, he may have to compensate us for the value. This may mean that he must nevertheless fulfill the contractual payment obligations for the period up to the revocation. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation, for us with its receipt.
Special notes
The right of withdrawal expires prematurely if the contract has been completely fulfilled by both parties at your express request before the customer has exercised his right of withdrawal.

§3 Cancellation, amendment
Cancellation of a lecture, seminar or workshop is possible free of charge up to 12 weeks before the start of the event, provided that it is received by Ilja Grzeskowitz in writing (e.g. by e-mail). If the written cancellation is received up to 8 weeks before the event, 50 % of the seminar or workshop fee must be paid. In both cases we will charge a processing fee of 100 €.

If a cancellation is made after this time, the full seminar fee is due. The customer is free to send a substitute participant, provided that this person fulfills the requirements for admission to the seminar in question. These regulations apply exclusively to the standard price. For early bird prices or other discounted offers that include a discount, only the 14-day right of withdrawal applies. Ilja Grzeskowitz reserves the right to refuse participation in an event before or during an ongoing event without stating reasons. In the event of a serious reason, e.g. disturbance of the seminar atmosphere or similar, the full seminar fee will be due. Otherwise, only services already received will be invoiced (pro rata if applicable).

Ilja Grzeskowitz is entitled to change the venue at short notice, provided that the associated changes are within reasonable limits. Ilja Grzeskowitz is also entitled to replace a trainer, speaker or seminar leader without giving reasons, without this giving rise to any claims for the customer.

Ilja Grzeskowitz is entitled to cancel an event for important reasons or to postpone it to a later date. Important reasons include, in particular, an insufficient number of participants or inability to attend due to illness. Ilja Grzeskowitz may also withdraw from the contract if event rooms provided to Ilja Grzeskowitz by third parties for the organization of the event are no longer available for reasons beyond the control of Ilja Grzeskowitz and no adequate rooms can be rented in good time. Ilja Grzeskowitz is entitled to agree an alternative date with the customer by mutual consent. The participant expressly waives any further claims against Ilja Grzeskowitz.

No claims may be asserted against Ilja Grzeskowitz. In particular, a claim for compensation for any travel and accommodation costs as well as loss of working hours is excluded, unless such costs arise due to grossly negligent or intentional behavior on the part of Ilja Grzeskowitz.

§4 Obligations of the customer
The customer assures Ilja Grzeskowitz that his details are truthful and is therefore responsible for the accuracy of his data. Communication with all customers takes place exclusively by e-mail. The customer must therefore ensure that they provide a valid e-mail address at which they can be contacted at any time.
During an event organized by Ilja Grzeskowitz, each customer bears full responsibility for himself and his actions and is liable for any damage caused.
The customer is responsible for accommodation and meals during an event.
All seminar documents, presentations, audio CDs, website content etc. made available to the customer by Ilja Grzeskowitz contain the copyright of Ilja Grzeskowitz and may not be published, reproduced or used for personal purposes in any form whatsoever without express written permission, including extracts.
Video or audio recording of the event is not permitted. Photography within an event is only permitted after permission has been granted by Ilja Grzeskowitz. Private photos may be taken as long as this does not disrupt the flow and atmosphere of an event.

§ 5 COVID rules

Public events, seminars, workshops and coaching sessions are carried out by Ilja Grzeskowitz in accordance with the applicable Corona regulations. The health of the participants is paramount and, depending on the applicable legal situation, it may be necessary to take certain measures such as wearing mouth and nose protection, 2G rules or similar.

If a public event, seminar, workshop or coaching session cannot be held as planned due to the coronavirus pandemic, a political decree or too many cases of illness, Ilja Grzeskowitz is entitled to postpone the event to a later date. Participants who have already registered must be informed of the rescheduled date as soon as possible. In this case, there is no entitlement to a refund of tickets or fees already paid. 

§6 Confidentiality agreement
Ilja Grzeskowitz is obliged to maintain complete confidentiality towards the customer. This confidentiality includes all contents of the training services, in particular all information which Ilja Grzeskowitz has received about the person of the customer and his private and/or professional or business environment and in particular all business and/or trade secrets of which the customer becomes aware in the course of the seminar. This obligation shall continue beyond the term of the contract and shall only expire insofar as the customer has given his express consent to this.

§7 Use of media
For the duration of the event, the customer shall permit Ilja Grzeskowitz or persons commissioned by Ilja Grzeskowitz to make audio and video recordings and to take photographs for the purpose of training documentation, publication and, in addition, for the purpose of advertising similar or identical events. There is no entitlement to any payments. The customer has the right to object to this permission in advance; a subsequent objection is not possible.

§8 Exclusion of liability
The customer participates in an event organized by Ilja Grzeskowitz at his own risk. Ilja Grzeskowitz is not liable for damages of any kind, unless the liability is based on a grossly negligent or intentional breach of duty by the seminar leader.

§9 Humor
Ilja Grzeskowitz has a positive attitude to life and enjoys life to the full. He also likes to laugh a lot, even if it sometimes involves serious topics. Ilja Grzeskowitz's events are not suitable for anyone who can't take a joke or goes to the cellar to laugh.

§10 Other
Agreements that go beyond these General Terms and Conditions must be made in writing. Should individual agreements or components of these General Terms and Conditions be invalid, this shall not affect the validity of the remaining General Terms and Conditions.
